PUBLIC NOTICECity of Torrington )County of Goshen )State of Wyoming )The Torrington City Council met in regular session on Tuesday, July 18, 2023 in the City Council Chambers at 436 East 22nd Ave. at 7:00 p.m. Present: Mayor Doby, Council Members Deahl, Kelly, Patterson and Viktorin. Also Present: Clerk/Treasurer Strecker, Attorney Eddington, Director of Public Works/City Engineer Harkins, Chief of Police Johnson, Buildings & Grounds Superintendent Estes and Deputy City Clerk Anaya.Mayor Doby called the meeting to order.Councilman Viktorin led the Pledge of Allegiance.Mayor Doby led the session with informational announcements on the following items: 1. Announcement that the City of Torrington is seeking public input and public comments regarding the potential introduction of casino-style betting on historic horse racing into the City of Torrington. A Public Meeting to gather public input on the potential business will be held on 07-25-23 at 3:00 p.m. in the Lincoln Community Complex Pony Express Room; 2. Announcement that the 08-01-23 Council meeting will be held in the picnic shelter at the northeast corner of Jirdon Park at 7:00 p.m. in conjunction with National Night Out, an annual event organized by the Torrington Police Department; 3. Mayor Doby invited the citizens of Torrington to continue to enjoy the parks, walking paths, ball fields, swimming pool and golf course that the City offers; and 4. Reminder to the public to please continue to familiarize themselves with the 17 newly marked pedestrian crosswalks.Councilman Kelly moved and Councilman Viktorin seconded to approve the consent agenda which includes the minutes from the 07-05-23 Council meeting as published and all actions therein be ratified. Motion carried unanimously.Councilman Patterson moved and Councilman Deahl seconded to approve the agenda as presented. Motion carried unanimously.Attorney Eddington read by title AN ORDINANCE AMENDING AND RE-ENACTING SECTION 9.24.030. OF THE TORRINGTON MUNICICPAL CODE, 2023 REVISIONS, RELATING TO THE DISCHARGE OF FIREARMS. Councilman Deahl moved and Councilman Kelly seconded to approve Ordinance No. 1280 as presented on third reading. Motion carried unanimously.Julie Miller-Harshberger with the 307 Sports Bar & Grill requested approval of a catering permit for a Zavorka Family Reunion to be held on 07-29-23 from 4:00 p.m. to 2:00 a.m. at 605 East 22nd Avenue (Saint Rose Parish Hall). Councilman Kelly moved and Councilman Patterson seconded to approve the catering permit as presented. Motion carried unanimously.Julie Miller-Harshberger with the 307 Sports Bar & Grill requested approval of a catering permit for a BlueBird Boutique One Year Anniversary Event to be held on 08-05-23 from 11:00 a.m. to 5:00 p.m. at 2042 Main Street (21st & Main). Councilman Viktorin moved and Councilman Deahl seconded to approve the catering permit as presented. Motion carried unanimously.Julie Miller-Harshberger with the 307 Sports Bar & Grill requested approval of a catering permit for a 1978-1993 Torrington High School All Class Reunion to be held on 08-18-23 from 4:00 p.m. to 2:00 a.m. in front of 1500 East Valley Road. Councilman Patterson moved and Councilman Viktorin seconded to approve the catering permit as presented. Motion carried unanimously.Chief of Police Johnson presented for approval a Jurisdictional Memorandum of Understanding (MOU) between Goshen County and the City of Torrington for a contract School Resource Officer (SRO) Program in Goshen County. He stated that the MOU will allow the Goshen County Sheriff’s Office and the Torrington Police Department to provide law enforcement authority for a contractual SRO partnership that serves Southeast High School, Southeast Elementary School and LaGrange Elementary School. Chief of Police Johnson indicated that the proposed MOU is identical to what was utilized last year. He commented that Mayor Doby articulated that these types of agreements should be approved by governing bodies not just by the Goshen County Sheriff and Torrington Chief of Police serving in their official capacity, therefore the MOU will be reviewed and submitted for official approval to each of the respective governing body entities on an annual basis. Councilman Kelly moved and Councilman Viktorin seconded to approve the Jurisdictional Memorandum of Understanding (MOU) between Goshen County and the City of Torrington as presented. Motion carried unanimously. Chief of Police Johnson presented for approval a Memorandum of Understanding (MOU) between Goshen County and the City of Torrington. He stated that the MOU will allow the Goshen County Sheriff and City of Torrington Chief of Police to improve public safety and increase efficiency and effectiveness in providing law enforcement service to all Goshen County residents. Chief of Police Johnson indicated that this particular MOU has been in place for quite some time now. He commented that there were a couple of items that necessitated review. Chief of Police Johnson stated that one of those items was related to transport. He indicated that there are instances where the Goshen County Sheriff will request the assistance of the Torrington Police Department (TPD) in transporting inmates. Chief of Police Johnson commented that it was imperative that jurisdictional authority be granted to the TPD in writing prior to any officer assisting with transports. He stated that the second item that needed to be updated was Exhibit A which lists the current roster for the TPD. Councilman Deahl moved and Councilman Kelly seconded to approve the Memorandum of Understanding (MOU) between Goshen County and the City of Torrington as presented. Motion carried unanimously.Chief of Police Johnson presented for approval a School Resource Officer (SRO) Intergovernmental Agreement between Goshen County School District No. 1 and the City of Torrington. He stated that the agreement will allow Goshen County School District No. 1 and the Torrington Police Department to provide contractual SRO services with the approval of the Goshen County Sheriff for schools in the southeast portion of Goshen County to include the following: Southeast Elementary School, Southeast High School and LaGrange Elementary School. Chief of Police Johnson indicated that the term of the agreement is for the 2023-2024 school year. Councilman Patterson moved and Councilman Viktorin seconded to approve the School Resource Officer (SRO) Intergovernmental Agreement between Goshen County School District No. 1 and the City of Torrington as presented. Motion carried unanimously. Director of Public Works (DPW)/City Engineer Harkins presented the bid results for the Navigational Aids (NAVAIDS) Replacement Project. He stated that staff recommends awarding the bid to WJR, Inc. DBA Robinson Electric of Gering, Nebraska in the amount of $454,528.80 contingent upon final approval by the Federal Aviation Administration (FAA) and the Wyoming Department of Transportation (WYDOT) Aeronautics Division. DPW/City Engineer Harkins indicated that the project consists of the replacement of the existing Precision Approach Path Indicators (PAPIs), Runway End Identifier Lights (REILs), and the rotating beacon and beacon tower, and the rehabilitation of the electrical regulator room. He commented that a bid opening was held on 06-14-23, and stated that the bid from WJR, Inc. in the amount of $722,634.44 was the only bid received and it was in conformance with the bidding requirements. DPW/City Engineer Harkins indicated that as only one bid was received, M.C. Schaff and Associates, Inc. contacted FAA, WYDOT and the Airport to request permission to enter into negotiations with the contractor, which was granted. He commented that the results of the negotiations discovered that the PAPIs could be connected to the existing RW 10/28 circuit and power supply, thereby eliminating the “home run” conduit, power and grounding wire, and junction cans from the PAPIs to the electrical regulator room. DPW/City Engineer Harkins stated that as a result of that change, the new revised construction cost was reduced to $454,528.80. He indicated that 90% of the $454,528.80 is reimbursable by the FAA and 6% is reimbursable by WYDOT, therefore the City’s share would only be 4%. Councilman Viktorin moved and Councilman Patterson seconded to award the bid to WJR, Inc. DBA Robinson Electric of Gering, Nebraska in the amount of $454,528.80 contingent upon final approval by the Federal Aviation Administration (FAA) and the Wyoming Department of Transportation (WYDOT) Aeronautics Division as presented. Motion carried unanimously.The bills from 07-06-23 to 07-18-23 were presented for payment. Councilman Kelly moved and Councilman Deahl seconded to approve the bills for payment as presented. Motion carried unanimously.Mayor Doby asked for public comments, questions or concerns.Chief of Police Johnson announced that the annual Cops and Cones Event is scheduled to be held on 07-25-23 at 3:00 p.m. at the Dale Jones Municipal Pool.Mayor Doby stated that Fire Chief Petsch provided him with a written report. He indicated that the report gave a brief update regarding the training that members of the department participated in last week that was held in conjunction with the Torrington Police Department and Torrington Emergency Medical Services. Mayor Doby commented that Fire Chief Petsch also reported that the fire potential has increased due to the current hot and dryer conditions. Councilman Viktorin stated that the Goshen County Fire Warden changed the current fire ban status to a “Level 1” earlier in the day. Chief of Police Johnson listed the exemptions that are allowed under the “Level 1” fire ban on private properties so long as certain guidelines are followed.
